COMPLIANCE DISMISSAL

OFFENSE ELIGIBLE FOR DISMISSAL 

  • Expired Registration / License Plate
  • Failure to Maintain Financial Responsibility (No Insurance)
  • Expired Texas Driver's License
  • Operate a vehicle without Two Valid License Plates
  • Operate Vehicle with Defective Required Equipment (or unsafe condition)
  • Fail to Report Change af Address or Name on Driver's License
  • Violate Driver's License Restriction

ACCEPTABLE PROOF OF COMPLIANCE  * Proof must be presented to the court. In some cases it may be required for the vehicle to be present for in-person inspection *

 

Expired License Plate (Registration): 

The form generated by the County Tax Assessor’s office, stamped, with the amount paid and date paid. The late penalty paid to the County Tax Assessor's office must show on receipt. The date of compliance is not more than twenty (20) working days after the date of the offense (OR BEFORE) the first court appearance date. *Dismissal fee is $10.00.

 

Fail to Maintain Financial Responsibility (No Insurance):

Defendant must provide proof the defendant or the vehicle was covered on the date and time the offense was committed. The Clerk must verify with insurance provider.  *No dismissal fee with proof.  [SEE FORMS TAB FOR MOTION FOR DISMISSAL FORM]

 

Expired Driver’s License:

The temporary license issued by the Department of Public Safety indicating renewal of the license and the date renewed is within twenty (20) working days after the offense date or before the defendant’s first court appearance, whichever is later.     * Dismissal fee is $10.00.

* If the Defendant did not have a driver’s license and goes to get one, the offense is not dismissible. *

 

Operate Vehicle Without Two Valid License Plates:

Defendant must remedy the defect before the defendant’s first court appearance; defendant must bring the vehicle to the court for verification. *Dismissal fee is $10.00.

 

Operate Vehicle with Defective, Required Equipment (or unsafe condition), including use of equipment not approved:

Defendant must remedy the defect before the first court appearance. Defendant must provide a receipt for the equipment and/or bring the vehicle for inspection. *Dismissal fee is $10.00.

 

Fail to Report Change of Address or Name on Driver’s License:

Defendant must remedy the defect within twenty (20) working days after the date of the offense or before the first court appearance.  *Dismissal fee is $10.00.

 

Violate Driver’s License Restriction:

Defendant must provide proof the restriction or endorsement was corrected within fifteen (15) working days of the date of the offense or before the first court appearance. *Dismissal fee is $10.00.
